Regulations
The conclusion of the contract between the Buyer and the Seller can occur in two ways.
The Buyer has the right to negotiate all provisions of the contract with the Seller before placing an order, including amending the provisions of the following regulations. These negotiations should be conducted in writing and directed to the address of the Seller:

If the Buyer decides not to negotiate the terms of the contract individually, the following regulations and relevant legal provisions shall apply.
REGULATIONS
§1 Definitions
1. Postal Address – the name and surname or name of the institution, location in the town (in the case of a town divided into streets: street, building number, apartment or unit number; in the case of a town not divided into streets: town name and property number), postal code, and town.

5. Delivery – the type of transport service along with the carrier and cost specified in the delivery price list located at: http://sport-bike.eu/Czas-i-koszty-dostawy
6. Proof of Purchase – an invoice, receipt, or fiscal receipt issued in accordance with the Act on Value Added Tax of March 11, 2004, as amended, and other relevant legal provisions.
7. Product Page – an individual subpage of the store containing information about a single product.
8. Client – an adult natural person with full legal capacity, a legal person, or an organizational unit without legal personality but with legal capacity, making a purchase from the Seller directly related to their business or professional activity.
9. Civil Code – the Civil Code Act of April 23, 1964, as amended.
10. Code of Good Practices – a set of rules of conduct, particularly ethical and professional standards, as referred to in Article 2 point 5 of the Act on Counteracting Unfair Market Practices of August 23, 2007, as amended.
11. Consumer – an adult natural person with full legal capacity making a purchase from the Seller not directly related to their business or professional activity.
12. Basket – a list of products made from the products offered in the store based on the Buyer’s choices.
13. Buyer – both the Consumer and the Client.
14. Place of Delivery – the postal address or pick-up point indicated in the order by the Buyer.
15. Moment of Delivery – the moment when the Buyer or a third party designated by them takes possession of the item.
16. Payment – the method of payment for the subject of the contract and delivery specified at: http://sport-bike.eu/pl/i/Formy-platnosci/10
17. Consumer Law – the Consumer Rights Act of May 30, 2014.
18. Product – the minimum and indivisible quantity of an item that can be the subject of an order, indicated in the Seller’s store as a unit of measure when determining its price (price/unit).
19. Subject of the Contract – products and delivery being the subject of the contract.
20. Subject of the Service – the subject of the contract.
21. Pick-up Point – a place of delivery that is not a postal address, listed in the summary provided by the Seller in the store.
22. Item – a movable item that can be or is the subject of the contract.
23. Store – the online service available at sport-bike.eu through which the Buyer can place an order.

25. System – a set of cooperating IT devices and software, ensuring the processing and storage, as well as sending and receiving data through telecommunications networks using a device appropriate for the type of network, commonly referred to as the Internet.
26. Delivery Time – the number of hours or business days specified on the product page. It is defined by the sum of two numbers: the time of waiting for shipment and the delivery time of the item by the carrier.
27. Contract – a contract concluded outside the business premises or at a distance within the meaning of the Consumer Rights Act of May 30, 2014, in the case of Consumers, and a sales contract within the meaning of Article 535 of the Civil Code Act of April 23, 1964, in the case of Buyers.
28. Defect – both a physical and legal defect.
29. Physical Defect – the non-conformity of the item sold with the contract, in particular if the item:
1. does not have the properties that an item of this kind should have due to the purpose specified in the contract or resulting from circumstances or its intended use;
2. does not have the properties that the Seller assured the Consumer of;
3. is not suitable for the purpose for which the Consumer informed the Seller at the time of concluding the contract, and the Seller did not raise any objections to such use;
4. was issued to the Consumer in an incomplete state;
5. in case of incorrect installation and commissioning if these activities were carried out by the Seller or a third party for whom the Seller is responsible, or by the Consumer who followed the instructions received from the Seller;
6. does not have the properties assured by the manufacturer or his representative or the person who places the item on the market within their business activity and the person who, by placing their name, trademark, or other distinguishing mark on the item sold, presents themselves as the manufacturer unless the Seller was unaware of these assurances and, assessing them reasonably, could not have known or they could not have influenced the Consumer’s decision to conclude the contract, or their content was corrected before the contract was concluded.
30. Legal Defect – a situation where the item sold is owned by a third party or is encumbered with the right of a third party, as well as when the restriction in the use or disposal of the item results from a decision or ruling of a competent authority.
31. Order – the Buyer’s declaration of will submitted through the store, specifying unambiguously: the type and quantity of products; type of delivery; type of payment, place of delivery, Buyer’s data aimed directly at concluding the contract between the Buyer and the Seller.
§2 General Conditions
1. The contract is concluded in the Polish language, in accordance with Polish law and these regulations.
2. The Seller is obliged and undertakes to provide services and deliver items free from defects.
3. All prices provided by the Seller are in Polish currency and are gross prices (include VAT). Product prices do not include delivery costs, which are specified in the delivery price list.
4. The Seller does not provide the Buyer with a guarantee within the meaning of Article 577 of the Civil Code but informs about the guarantees provided by third parties for products available in the store.
5. Confirmation, making available, consolidation, and securing all essential provisions of the contract to gain access to this information in the future takes place in the form of:
1. confirmation of the order by sending to the provided e-mail address: the order, information on the right to withdraw from the contract, links to independently download the regulations and the withdrawal form in the version;
2. attaching to the completed order, sent to the specified place of delivery of the items printed: proof of purchase, information on the right to withdraw from the contract, and a template of the withdrawal form.
6. The Seller does not charge any fees for communication with him using means of remote communication, and the Buyer will bear the costs in the amount resulting from the contract concluded with a third party.
